Zombie DACA Killed Again, But Stumbles On Like The Animated Undead

The manifestly illegal and unconstitutional Deferred Action For Childhood Arrivals (DACA) was, once again, pronounced an illegal and unconstitutional action. But like a zombie, it continues to stagger on animated only by a seaming fear in judiciary to give it the coup de grâce that it so richly deserves. Long ago heroic Judge Andrew Hanen declared a similar Obama Regime Administrative Amnesty, Deferred Action For Parents Of Americans (DAPA), both illegal and unconstitutional; that the program was not authorized by law and was implemented in an illegal manner, violating the Administrative Procedures Act (APA), as well as violating the Constitution, which reserved making immigration policy to the legislative branch of government.

Similarly, Hanen later declared DACA to have the same profound legal and constitutional problems, it exceeded the authority given to the executive branch to, on a case-by-case basis, grant employment authorization to certain aliens, failed to adhere to the APA, providing notice and comment as part of the regulation making process, and violated the Constitution by creating immigration legislation, an amnesty, in a usurpation of the legislative authority of Congress.

In the end, DACA and DAPA were and are manifestations of ongoing illegal administrative actions by the Obama and Biden Regimes, along with allies in the ethnic lobbies and the Treason Bar, to give amnesty to illegal aliens, and destroy the historic American nation with a wave of illegal aliens.

But even when Hanen initially killed DACA, he allowed those illegal aliens in the program to zombie on, retaining and renewing their DACA work authorization indefinitely...

Judge Hanen should just end the program, require DHS to end renewals at a minimum, which would gradually age out the DACA population, or, better yet, require DHS to terminate the employment authorization for each illegal alien and recover the Employment Authorization Document (EAD) issued to those 500,000 or so illegal aliens.
